Terms of service
These terms govern your use of the fuseanalytics.com website, its guides and its tools; they are not the subscription agreement that governs the Fuse Analytics platform itself.

1. Acceptance of these terms
These terms of service (the “terms”) are an agreement between you and Fuse Analytics (“we”, “us”, “our”) about your use of the fuseanalytics.com website, including its pages, guides, calculators, assessment tools and forms (together, the “site”). By using the site you accept these terms and our privacy policy. If you do not agree, do not use the site.
If you use the site on behalf of a company or other organization, you confirm that you are authorized to accept these terms for it, and “you” includes that organization.
2. These are website terms, not the platform agreement
The site describes the Fuse Analytics archiving platform, but it is not the platform. Access to the platform, the archive it holds and any professional services are governed by a separate written agreement between Fuse Analytics and the customer (an order form, subscription agreement or services agreement). If anything in these terms conflicts with that agreement, that agreement controls for the customer’s use of the platform.
3. Permitted use of the site
You may browse the site, read and print its content, and use its tools for your own or your organization’s internal evaluation of HCM and payroll data archiving. You agree not to:
- copy, republish, sell or redistribute site content or the guides we send you, other than sharing them internally with colleagues who are evaluating the same project;
- use automated means (scrapers, bots, crawlers) to extract content or data from the site, except search engines indexing it in the ordinary way;
- probe, scan or test the site or the form endpoint for vulnerabilities, or interfere with its operation, security or availability;
- submit false, misleading or third-party information through the forms, or submit forms in bulk;
- remove or alter copyright, trademark or other notices;
- use the site or its content to build a competing product or service, or to train a machine learning model;
- use the site in any way that breaks applicable law.
We may suspend or block access to the site for anyone who breaches these terms, without notice.
4. Intellectual property
The site and everything on it (text, graphics, the Fuse Analytics name, the Fuse Analytics insignia, page designs, guides, calculators, assessment logic, downloadable documents and the way they are arranged) belong to Fuse Analytics or its licensors and are protected by copyright, trademark and other intellectual property laws. Nothing in these terms gives you any ownership of them. You receive only the limited, revocable, non-transferable permission to use the site described in section 3.
UKG, ADP, Workday, SAP, SuccessFactors, Dayforce, Ceridian, Oracle, PeopleSoft and other product names on the site are trademarks of their respective owners. We use them to identify the systems our platform works with. Their appearance does not mean that those companies sponsor, endorse or are affiliated with Fuse Analytics.
5. Guides, tools and content are information, not advice
The guides, blog posts, calculators, the M&A assessment, the retention-period material and everything else on the site are provided for general information. They are not legal, tax, accounting, compliance or other professional advice, and they are not a substitute for advice from your own lawyers, auditors or advisors who know your facts.
In particular:
- Retention periods, regulatory references and compliance statements on the site are general summaries that may be out of date, may not apply to your jurisdiction or industry, and may have changed since they were written. Verify them against current law before relying on them.
- Calculator and assessment results are estimates produced from the numbers and selections you enter, using simplified assumptions. They are not a quote, a promise of savings or a valuation, and they are not a basis for a purchase decision on their own.
- Descriptions of what the platform can do are general; the features, scope and service levels you actually receive are those set out in your customer agreement.
You are responsible for how you use anything you take from the site.
6. Submissions through forms and email
When you submit a form or email us, you confirm that the information is accurate, that you are entitled to provide it (including the work email address you use), and that you agree to be contacted about your request. We treat submissions as described in the privacy policy; they are not confidential beyond that, so do not send confidential business data, personal data about your employees, or account credentials through the site. We may use any feedback or suggestions you send us without obligation to you.
7. Third-party links and services
The site links to services we do not control, including Calendly for scheduling calls, LinkedIn, and the websites of the HCM and payroll vendors we write about. Those services have their own terms and privacy policies, and we are not responsible for their content, availability or practices. A link is not an endorsement.
8. No warranties
The site and its content are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, and any warranty that the site will be accurate, complete, current, uninterrupted, secure or free of errors or harmful components. We may change, suspend or remove any part of the site at any time.
9. Limitation of liability
To the fullest extent permitted by law, Fuse Analytics and its officers, employees, contractors and agents will not be liable for any indirect, incidental, consequential, special, exemplary or punitive damages, or for lost profits, lost revenue, lost data or business interruption, arising from or related to the site or its content, however caused and under any theory of liability, even if we were advised of the possibility. To the extent liability cannot be excluded, our total liability to you for all claims relating to the site will not exceed one hundred US dollars.
Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you, and you may have additional rights.
10. Indemnity
To the extent permitted by law, you will defend and indemnify Fuse Analytics against claims, losses and reasonable legal costs arising from your breach of these terms, your misuse of the site, or your violation of a third party’s rights.
11. Governing law and venue
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Any dispute relating to these terms or the site that cannot be resolved informally will be brought exclusively in the state or federal courts located in Fulton County, Georgia, and you consent to the personal jurisdiction of those courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
12. Changes to these terms
We may revise these terms from time to time. The date at the top shows the current version. Changes take effect when they are posted on this page, and continued use of the site after that date means you accept the revised terms.
13. General
If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these terms; we may assign them to a successor to our business. These terms, together with the privacy policy and any customer agreement referred to in section 2, are the entire agreement between you and Fuse Analytics about the site. You agree that we may communicate with you electronically about your requests.
